Review of the Free Trade Zone Act 2000 and Introduction
of An Enabling Act and Regulations to create and administer the
Madang Marine Industrial Park Project in Papua New Guinea
The National Management Committee established by the National Executive
Council (NEC) to oversee the MADANG MARINE INDUSTRIAL PARK PROJECT
(MMIPP) is calling for Expressions of Interest from Law firms and
consultants to undertake the above review as per the following TOR:
1. Review of the Free Trade Zone Act 2000 and Regulations to enable
effective implementation of Special Economic Zones, Export Processing
Zones, Industrial Centres/ Parks and Free Trade Zones (collectively
referred to as Ecozones) and come up with an Enabling Act and Regulations.
2. Prescribe the types of Ecozones and ownership structure (private,
government/provincial government or both) that can qualify under
the Enabling Act and operational guidelines under the Regulations.
3. Provide different management options to manage the Ecozones
based on best practices and models within the region and in the
world.
4. Consideration of a Special Purpose Company owned by the Government
of PNG as the vehicle to develop the MMIPP within the mandate of
the Enabling Act and Regulations.
5. Review of relevant Acts and policies pertaining to Investment/Foreign
Business Registration, Migration/Entry Visa, Work Permit, Customs/Tariffs/Excise
Duties, Tax, Harbours Board, Water and Sewerage, Electricity, Telecommunication,
Environment and Conservation, Lands, Central Bank, Fisheries Management
and Licensing requirements, etc and with a view to create an enabling
Act that will provide and guide the establishment of a ‘One-Stop-Shop’
facility and its management and monitoring of locators in designated
Ecozones.
6. Review of the Incentive Package, namely Pioneer Industries Status
Act, Customs Tariff Act and other relevant Tax Incentives Schemes
with the view to promote new investment in these designated Ecozones.
7. Review of the current local business spin-off schemes, employment
contracts and awards schemes with a view to promote active provincial
government and local resource owners/community participation.
8. Conduct meetings and consultations with key stakeholders, both
State and non-State actors to gauge their views towards preparation
of a draft Bill for Cabinet endorsement and subsequent enactment
in Parliament.
9. The consultant is expected to take four (4) weeks to complete
the task.
